Flight terms and conditions
Conditions of Contract: Early Morning Balloons Ltd. (thereafter called the Company) undertake to use their best efforts to carry passengers on the date booked. However the date is not guaranteed. All flights are subject to delay or cancellation due to weather, mechanical difficulties, government action, acts of God or any other cause whatsoever, including the fault of the company or any of their agents or employees. The Company shall not be responsible or liable to the passengers for any delay or cancellation of the flight.
Pilots’ rights: The pilot shall have the right to refuse to carry any passengers if carriage of such passenger may endanger safe flight of the balloon or pose any threat or hazard whatsoever to the well-being of any other passenger or any member of the company’s crews.
Flight Safety: In the interests of passenger safety the company must be informed of any physical disability or limitation, or medical condition that may be affected by the flight.
Refund Policy: The passenger may cancel his/her reservation for a balloon flight at any time prior to five business days before the scheduled flight and receive a refund of the full amount, less a 12.5% per passenger processing fee. In the event of a cancellation anytime during the five businesses days prior to the flight or failure to arrive in time for his/her flight, the passenger shall not be entitled to a refund of any portion of the full amount paid.
Please Note: Ballooning activities that intrinsically involve the possibility of physical risks greater than those encountered in daily life are conducted under the supervision of qualified and government licenced balloon pilots. By taking part in such ballooning activities passengers on each flight acknowledge and assume the risks inherent therein, and absolve Early Morning Balloons Ltd, their agents and affiliates of any liability for accidental injuries and/or expenses arising therein.
Expiry Date: This ticket expires on the expiry date shown. If at least 3 flights have been offered prior to that date but not accepted by the ticket holder, then the full ticket price shall be forfeited to Early Morning Balloons Ltd. If the ticket has expired a new ticket can be issued. Please note the new ticket will be reissued at the current price of a flight.
A flight will be cancelled without hesitation should the weather condition be unsuitable. It is then the responsibility of the recipient to reschedule as soon as possible.
Bookings: The recipient of this ticket must contact Early Morning Balloons Ltd to arrange flight times etc in the event of a postponed flight, re-booking is also the responsibility of the recipient.
